1. About these terms

These Terms of Service ("Terms") govern your use of the Eat Drink Explore mobile application ("the App") and website ("the Site"), operated by Historic Warwick App Ltd (company number 15173984), trading as Eat Drink Explore.

By downloading, accessing or using our App or Site, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Our services

Eat Drink Explore provides a platform to discover restaurants, bars, cafes and experiences, and to purchase and redeem voucher packs offering discounts at partner venues. We act as a platform connecting users with partner venues and are not responsible for the goods or services provided by those venues.

3. Account registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Vouchers and purchases

• Voucher packs are available for purchase through the App at the prices displayed at the time of purchase.
• All prices are in pounds sterling (GBP) and include VAT where applicable.
• Vouchers are subject to availability and may be subject to specific terms and conditions set by individual partner venues.
• Vouchers are non-transferable unless stated otherwise.
• We reserve the right to modify or discontinue voucher offerings at any time.

5. Refunds and cancellations

Digital voucher packs are provided as digital content. Under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period from the date of purchase. However, if you begin redeeming vouchers within this period, you acknowledge that you lose your right to cancel.

If you experience a genuine issue with a voucher (e.g. a partner venue has closed), please contact us and we will do our best to resolve the matter.

6. Acceptable use

You agree not to:

• Use the App or Site for any unlawful purpose.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Submit false, misleading or fraudulent information.
• Reproduce, duplicate or resell any part of our services without permission.
• Use automated tools to scrape or extract data from our services.
• Post reviews or content that is defamatory, abusive, obscene or otherwise objectionable.

7. Intellectual property

All content on the App and Site, including but not limited to text, graphics, logos, images and software, is the property of Historic Warwick App Ltd or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or create derivative works from our content without prior written consent.

8. Third-party venues

Partner venues listed on our platform are independent businesses. We do not control and are not responsible for the quality, safety or legality of their goods or services, the accuracy of their listings, or their ability to honour vouchers. Any disputes regarding goods or services provided by a partner venue should be directed to that venue in the first instance.

9. Limitation of liability

To the fullest extent permitted by law:

• Our services are provided "as is" without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, special or consequential damages arising from your use of our services.
• Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Changes to these terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
